i live in Tennessee. Kids mom whitch i have a agreement with for visation to meet half way in asheville ,nc but she says that her transmission is out and i have not seen my son in 2 months (2 visations missed) it's a 6hour drive to get to her house one way. she drives her car around where she lives. if we go to court over this what will come of it I going to be out more money the same thing will happen 6 months down the road more $$$ she not stoping me from seeing him but it almost impossable. what is the point of having an agreement signed by th jude if she does comply whith is she is all ways late for the 6:00 meet time. and is a true witch sent him here with ringworm and scabes luck knowone in the famly got it never said one thing about it.

If a judge said that she has to do it, she has to do it. How does she get around to do everything else? If your son was sick at school and she was at work, what would she do?

If I were you, I would drive all the way to pick up my son. I would also document this. Maybe you can recover a part of the extra expense that this is putting on you. I would not let this stop me from seeing my son.

Did you guys always live that far apart? Are was her meeting you half way in the agreement so she could move away?

If it is ordered that you split the cost of travel or if you meet in the middle, and you drive all the way to pick up your son, keep all reciepts from the trip. Keep a record of the milage on your car. I had to drive from Dallas to NC right after 9/11, for my daughter to have visitation. It was ordered that all travel expenses were to be split evenly. I kept ALL of my reciepts (including food and hotel). He had to reimburse me 50% plus 50% of mileage on my car.

If she doesn't want to agree to that, she can always get on a bus to Asheville. :)

in the papers says"both partys will agree to meet hafe way" I don't know if it is 50/50 or what. we didn't always live this far a part use to live 30 min down the road. the order was put in after she moved 3 years a go. she lives near her parents. the lawer says write her a letter. and she not stoping me from seeing him just refuses to meet me untill its fixed. 12hour round trip for a one day of vistion its not bad if she meets me. the kicker is that she still is driving the van that she is compalaining about her husband is has a hot rod pos he works on it and not he van. it always some thing with her never just what it needs to be thanks all for the help ALL

I agree with your atty. Write her a letter stating that since she is unwilling to find a solution to her problem she will be responsible for reimbursing you for half of your travel costs.

Can your child stay with you an extra day if you have to waste the day to go get him? If not, you can always use the road trip as an adventure. Stop at the overlooks, have a picnic, go to some waterfalls. I used to drive I- 40 and 64 up there all of the time. There are some beautiful free things you can do on the trip back. If your child likes to camp, what about going camping in Pisgah or around Cherokee or Maggie Valley?

I know that it doesn't solve your problem. Just some ideas to make it a little easier on you and salvage some time with your child.

Again, I agee with your attorney. Can you afford to have your attorney write it for you? Sometimes a letter from the attorney can light a fire under a person's butt better than a letter from you can.
