I was hoping someone could answer my question..
My long term boyfriend has 2 children that have his last name. He was never married to the mother of his children and she still has her maiden name.
She's now pregnant and her boyfriend walked out on her so she's trying to say that she wants to use My boyfriends last name so that all of her kids have the same name. He doesn't want that child to bare his name.. Is it possible that she could name the child after him without him signing the birth certificate?? or without her having that last name also? Will they make the child bare her last name since there's no daddy in the picture?? We reside in Kansas.. and I know that if there's a way to do this.. she'll do it.. and that's a concern of ours. He's even willing to take a paternity test if it comes down to it b/c he knows it isn't his and he doesn't want any part of it.. I'd appreciate any help I can get!! Thanks!

Unless he adopts the child or accepts paternity of the child, I do not think she can give the child his last name, especially if he contests it in court if she does. The court should have her last name or that of the bio father though that likely will not occur if he does not acknowledge paternity.
