View Full Version : Dad says I verbally agree against court order Child Support & Vistation

I need some advice on my situation. I have a daughter who turned 17 in Jan. her father and i divorced in 94 we are in Louisiana. I remarried in 95 and so did he, we both had attorneys and agreed upon 40.00 per week child support being he didnt have a very good paying job. He paid child support and did the visitation, every time it was her weekend to go it was an issue she cried n begged not to go. this went on until 96, I tried to have it to where she didnt have to go but he insisted, Then finally i guess he had enough on his weekend he never showed up to pick her up and it was kinda a releive for me because she cried and was miserable the whole weekend and would sneak to phone and call just a crying, i called police and they checked on her and said she was ok and there was nothing i could do being it was court ordered and his weekend. when i picked her up on sunday it was like she had been gone for months the way she held on to me. So i never pushed the issue of her going back i went for a month when it was her time to be with him and he never showed up to get her, He contuined to pay the child support up until 99 then he just stoped. I never done anything about it We would see him in town and he would not even speak or acknowledge she was in the car beside her. My new husband passed away in 95 and my daughter and i were able to get Social Security from him. When she turned 16 mine stopped and i went back to work to make ends meet. Her father is now a liscensed air n refrigration(have no idea what he makes ) and also works at a local box factory here in town making 18.00 a hour i found this out and called attorney becuase he was ordered to pay insurance if job offered, he had the family plan and had his other 3 children (now his adopted 4 years ago) on it all for one cost. He never sent me a insurance card but the place she went to I had friends and they got a copy of the card from him when he visted so my daughter could be seen there. In 2001 he was arrested for indecent behavior with his adopted 13 year old daughter. i saw this in the paper and began questioning. Well i get served with paper right after this for a reduction in child support which he had not been paying since 99 i was really confused. I go to court sit all day only to find that he has filed this in the wrong court and would have to be filed in civil court. I was so mad. when it was over. I did speak to him and his wife and ask why he was doing this he hasnt paid since 99 or called or acknowledged her at all and from what i saw in the paper i was so glad because it could have been my daughter this had happened to instead of his adopted daughter, they claimed she made it up and it was all dropped. I went this Jan 2006 to our local non support office and asked questions on how this worked they told me they could deffeintly help me and would go back from 99 to make him pay , we did all the paper work and it was over 15,000.00 dollars. He was served and since then i have received 7 payments of 42.00 each. Now a week before court the Non support ofices calls and asks me if i would agree to 5000.00 he had offered and drop arrears and he would contuine on until she finished school with support. I said no i would not.So where i was also told we would file for increase since it had been so many years since we set the 40.00 a week and his jobs were different. Well 4 days beofre court he serves me with reduction papers for support. On our court date last week he showed up with attorney and his parents, His attorney talks to head lady there and then calls me in the back. They are saying my x's wife is having surgery this morning and needs to set another court date being she is his main witness that we verbally agreed to stop child support and vistation.. I could have fell out the chair. he says she is his witness. I have not agreed on anything like this. I have not signed anything .So my question is where do i stand? It is his word against mine and if we verbally agreed why is he paying child support all of a sudden and offered me the 5,000.00 This is just why i havent done anything sooner, But my daughter sees the things he does for the other children and goes to school with them and says mom take him back to court and make him do for me also after all i am his blood. Any advice would be apperciated

Consult an attorney, but whether you accept the offer or not is up to you. I am not sure if what he says you verbally agreed to really matters to a court.
