The Question I have is that my work place has now took away breaks and smoke breaks. I know that indiana law says that they do not have to give breaks at all but can they give one person a break and not another and while on a break can they tell you that you are not allowd to smoke. Also is there anything saying that even arfter working X amount of hour 8 10 or 12 they still do not have to give you a break to eat or anything .

Since Indiana law does not require rest breaks or meal periods, the employer is free to set whatever standards it chooses. So, if breaks are provided to one employee and not the other, unless it is SOLELY due to a protected characteristic, such as age, race, gender, etc., it is not illegal. And btw, being a smoker is not a protected class, either federally or in your state.

And the employer may prohibit the employee from smoking on the premises at all, even if the employee is on a break. That's because there is no law keeping them from doing so.

im also in indiana and employers are taking advantage and exploiting the no break rules set,
who can we contact or write to to form a petition for it?
we are really being abused by it because it seems im not the only one being mistreated,ive worked 10 hour shifts before and got no breaks,
and nothing is done to my employer for it,no extra pay for me?and if i take it with out approval i can be fired,
