Situation: My 21 year old son has a 1 1/2 year old son with his former girlfriend. He is paying child support that he has withdrawn from his paycheck. No problem with that. His ex has no job and collects welfare including subsidized housing. Now she is wanting him to take care of his boy for 4-5 days a week. Since my son pays child support can she force him to watch him most of the time and still collect the full amount of child support? How is child support figured anyway? My state is Iowa. I have a lawyer appointment in 2 weeks and would like as much information as possible. Thank You for your help.

If he is paying court ordered child support, then if he chooses to watch his child he should take note of the hours he has his child then go back to court to get his support modified because most courts will look at that he is spending time with his child and they might reduce his support payment.

Is there a court order dictating custody and visitation? If there is, and she is wanting your son to care for the child the majority of the time, why doesn't he file for custody modification? If not, he should file for primary custody. :)
