View Full Version : What rights do I have to terminate my lease? in Illinois

I have rented a condo from my landlord, live in Chicago,and I have lived there for almost 3 years now and everything has been ok up until the past couple of months.
When I moved in, I signed a lease with a clause that will give my landlord the right to sell the apartment if he can find a buyer and he will compensate me for 30days free rent for the inconvinience, so far 3 years later no one has been intrested to buy it but I have had approximatly 40 people all together that has been over to look at the place through out the years. The problem that I have now is that more and more often he calls me up one day and wants to show the place the next day, I have bent backwards so many times to please him and always said yes but the last time he called it was a monday afternoon and he told me that he will be there the fallowing morning at 9am with a broker to inspect the place.since I work late nights til 4 in the morning my partner opened the door and asked him if he "wasn't suppose to give us 48 hours notice prior to enter the apartment" and he said NO!, he can enter the place anytime he wants!
A few days later he called me to discuss the condition of the apartment and told me that it is not well taking cared of at all. Which i don't agree with at all, I have always cleaned up my place prior to someone coming over to look at the place but this time I didn't do it because I am so sick and tired of him not giving me a 48 hours notice prior to coming over, which I have been told that is the law here in Illinois, even though he denies that. And he also accused me of being rude to the brokers that comes over, which is not true at all, I have always been home, even taken off from work so I can be home when they come over since I have a dog and don't want any problems with that, the only thing I do is, sit in my office with my dog when they come over. So his solution to the problem was to hire someone to come over and clean the place for 5 hours every week and we would split the cost!!! I already pay $2200/ monts and can not afford any more expenses or he wants me to vacate the place since he thinks that it will be easier to sell the place with no tenant. He told me to think about it and he was going to get back to me in a few days, he called me a few days later, unfortunatly I was out of town for a week so I couldn't get back to him until I came back and I called him as soon as I came home since he had called me 5 times and treatened to send a letter to me about the conditions if I didn't call him back ASAP.
I did call him back and he told me that I had to options, either agree with having someone come over and clean once a week and share the cost or terminate the lease, I said that if that is the case he has to terminate the lease. He said he was going to send me a letter! Haven't received it yet though.
2 years ago my partner came home with a puppy since it is a dogfriendly building and 50 % of the tenants has dogs, I was against it since it states in my lease that NO pets is allowed without prior concent from my landlord, it was not right to do but the bottom line is that we do have a dog and have had it for 2 years now, we had some problems at the beginning with the dog urinating in the lobby, which we of course cleaned up ourself but we still got a warning which was sent to the the condo owner as well so he found out that we had broken the rules in the lease agreement about not having any pets without prior concent. We were then called to the Board of Directors about the incident, in which we, the tenants and my landlord showed up to, and we were supposely going to get a fine but we didn't, after that no more incidents with the dog has happened, and my landlord was ok with us having a dog, otherwise he wouldn't have signed another lease for us to stay here but can he terminate the lease on the grounds that we didn't fallow the agreement about NO pets?
In the apartment we have a white/grey carpet that has been there for atleast 5-6 years now and when I moved in it was really nasty and with a puppy, accidents happen with him peeing inside so I went and bought a Steamvac, the best one on the market, which I use probably once a week to get the carpet clean and keep it as fresh as possible, one time the steamvac ruined a piece of the carpet, kind of ate it, so there is a piece that is not so pretty but how are you suppose to keep a carpet look like brand new after 5-6 years and it is white? When can U demand to get a new one?
Also the place needs a paint jod, white walls doesn't last for forever and it was not newly painted when I moved in, how often can U demand a paint job?
And I pointed out that it would be wise to put in hardwood floors and repaint the place in order to increase the value of the home but he doesn't want to spend a penny on the place and he hasn't spent anything trough out the 3 years that I have lived there, but I have paid over $ 75 000 in rent!
I am afraid that he will charge me for the carpet and expect me to pay for a paint job when I move out which means that I will not get my security deposit back.
I have also read somewhere that I have the right to get the intrest from my security deposit at the end of each year when the lease is up, which I haven't received either. Is that true?
The bottom line now is that I am so sick and tired of living here and would do anything to get out of my lease, but ofcourse I don't want to get sued if I break it on illegal grounds, what rights do I have to break the lease, if any?
Please, if anyone know, TELL ME! I am sick and tired of it but I don't want to loose my security deposit or get sued!

Take your lease to an attorney for review and to develop strategies to get out of your lease. Sometimes, landlords may let you out if there is a mutual releasea nd you let them keep the deposit or deposit plus a month's rent as damages.

I thought you said that he wanted the place empty anyway so he can sell the condo? You should be able to talk to him about ending the lease. If there is damage to the property then he has the right to use the security deposit for the damages. About the pet...Just ask him about moving because if he is trying to sell the condo he probably will agree to end the lease early.
