View Full Version : Indiana-I pay 100.00 more a month than other tenants

When I saw the ad for this apartment in the paper it said 2 BR 540.00 a month + Electric. Sounded wonderful only problem was it's located in a small town where I grew up (and there's virtually no black people). My boyfriend (fiance) is black and my children are mixed (2 children). So when I went to rent from the landlord I applied (being I am the one with the income because he watches the kids because I make better money ... none of the landlords business.. anyway) I applied. I said it was me and the children because I really needed the apartment and didn't want to risk him turning me down because my fiance was black (which I know is illegal but it happens). After I moved in the maintenance guy told the landlord that my boyfriend was living here and he raised my rent by 100.00 a month making my rent 640.00 he never gave me a new lease, he told me verablly I was to pay this amount. It does say on the lease that he gave me 100.00 per additonal person living in the residence (when it originally had said 25.00 but he scratched that out and made it 100.00). However, other families of 4 are living in the building and paying 540.00. I'm not sure if this is discrimination or what the situation is. I guess it's my fault for not being up front, but at the same time water useage isn't really a good enough reason for me to have to pay an additional 1200.00 a year. (ALSO, THERE ARE ROACHES HERE - which I asked before I rented if there were any roaches and they said no!) - do I have any recourse. I am still living here and don't wanna rock the boat, but is there any action I can take? OH AND ONE MORE THING... I have one window with a screen. I have asked several times for screens they said they don't have any and I should go buy a screen kit from Menards and then have the mainteance guy put it together. I am paying an additional 100.00 per month and I think he should buy them out of the money...

You lied. Maybe the rate for two adults is different than for one adult. If you are unhappy, read the lease and seek to terminate the lease under the lease provisions for terminating the lease. You also may want to negotiate a mutual release from the lease if you can let the landlord retain the deposit. You maybe should ahve done more research.
