View Full Version : "Wrongful Termination" Malicous Rumors?

[FONT=Comic Sans MS] The day was March 28, 2006, I went to eat lunch at the establish in which I worked at at the time. I noticed that a server was bartending. So I proceeded to ask her where was the bartendar that was suppose to be on duty she said, "he called in and they asked her to fill in for him". So I saw the bar manager while I was there asked him what exactly was going on. We went into another room and he told me there were some changes about to be made. I said ok what's up. He said that the bartendar that had called in had been and up and down situation so he was gonna bring one of the servers behind the bar. I said ok. Then he proceeded to tell me that he was taking two of my bar shifts which were Monday dayshift and every other Friday day shift. Now take into mind that I only work three dasys a week at this place. So I was somewhat confused as to why my shifts were being taken and I had not been in trouble at all. So he tells me that he needs someone that is gonna be here full-time and the server he was bringing behind the bar this job was her only job. Unlike me because I attend college courses two days out of the week and I'm a member of the student government association which I have worked around since I have been employed there for almost eleven months. I told him that I could pick up more shifts if he needed me too. He said that he needed a full-time bartendar and that he was gonna make me an on-call bartendar so if no one calls in I only work one day a week. So he said he was also gonna take some shifts from the bartendar that had called in I said ok. He told me that this would go into effect April 10, 2006, which meant I would have two bar shifts I was gauranteed after it was up in the air. The next day I called to see if the bartendar that had called in the previous day had came in for work and he was there so I informed him of the information that had been told to me. I'm guessing since I was not there at the restuarant when it happened he asked the bar manager about this ordeal, and I'm guessing that the bar manager is denying that he ever had this conversation with me. So about 6:38 p.m. March 29, 2006 I receive a phone call from the bar manager saying that he has to let me go and I asked why he said for spreading malicious rumors. So I asked him what were those malicious rumors then he told me that he could not go into that. So now I am unemployed and I mad because of the way that the situation was handled. Is there anything that I can do about this?

No, it does not appear that any laws were violated in this situation. This falls into the category of unfair, but not illegal.
