:confused: Here is the issue, my ex and daughter had a massive fight and she moved in with me two years ago, I have never asked or requested child support from my ex since that time, now my daughter wishes to continue living with me through high school (next 4 years) my ex doesn't think she needs to pay child support, but I am going to go through the court system and make her...
what I want to know is in CO, about how long does this take...
also can I go for back C/S for the past two years...there has been no modifications to our decree since my daughter moved in... so as of now my ex still has all legal and residential rights...
I know I screwed up by not changing this in the beginning but I thought we could work this out like civilized adults (how wrong was I)....

The best advice is to make sure you change everything legally in the courts, even if you ever think it can work out civally, it never does, don't take that risk. Your first action is to change custody. After that, you can try and ask for back child support, but it isn't likely you'll be awarded it. If anything, you may still be liable for any support you were supposed to pay her since you didn't modify the custody when your daughter came to live with you. I am not so sure that was a bad decision, if you had gone for modification in the beginning it could have caused her to demand your daughter go back to live with her (which she would have the right to do since she was custodial parent). Sometimes (for the sake of the child) it's best to wait it out and see what happens in this type of situation. Now you have 2 years of her living with you proving it is a good situation, that will look good for you when modifying custody. What your ex thinks about whether or not she should pay child support really isnt' her decision, it's the courts, so her opinion really doesn't matter.

thanks for the info...right now I'm totally confused on what I'm doing...
I am going to go first thing in the am and get the paperwork started...
is this something that can be done without an attorney...
