HI, I am aware this is not professional legal advice; I would just like to know if this suit would work from ppl who know a little about this kind of stuff.
In the months from august 2005-october 2005 I had a friend move in with me and my son. We allowed her to live in my son’s room and he used the living room for a bedroom for these three months. When we approached the owners of the building to ask them if she was able to move in they requested she fill out an application form, and later was approved; however she never got a round to signing the lease. Three days after the application form was approved the rent was due, but she did not have it, and I could not cover her half of the rent believing I could spend the access funds. This occurred also with the power bill for the next three months. There was a small amount of money paid however with no receipt. Subsequently we were evicted after these three months, leaving my son and I homeless. We eventually moved into a small one bedroom appt. Now, in April, I am trying to move into a new appt. but cannot because of the bad reference this appt. building is giving everyone. There is still past due rent as the "friend" repeatedly said that she would pay but never did. This is what I need help with. can I take her to court to pay even though I have no evidence of her not paying, except the application that proves she moved in, and can I use the fact that she has repeated history of not paying for rent and a horrible credit rating.
