I work in an assembly plant, that ends up painting there product before shipment. On first shift there are 3 painters, two in and one on a half hour break, that rotates in. Two painters painting for an hour and one that releaves each, so they get a half hour away. We paint with supplied air. On second shift there is only one employee. This employee does not get the half hour away from the painting. When he paints he does the work for The two painter that would be on first shift. Does (is) the painter on second require ( entitled ) to the half hour away every hour like the first shift gets? The company says NO, That is a first shift thing, because there is three painters on first. But, second shift there is only one painter. That is why you don't get the half hour away. Any suggestions would help. Thank You....

Unless there is an OSHA requirement that I am not aware of (I'm not an OSHA expert so it's possible) Ohio law does not require any breaks of any kind. It is not discriminatory to allow breaks on one shift but not another; therefore, my answer would be a qualified no, there is no entitlement to the break.
