View Full Version : Diminshing halftime pay for overtime?

The company I work for just recently started to pay overtime as "diminishing halftime" for any hour over 40 hours in a week. In other words, our "halftime" decreases as the overtime (over 40 hours per week) increases. We are paid on a "flex-time" plan due to our rotating shifts; 36 hours one week then 48 hours the next. Is this legal? And if so, where are the regulations about diminishing halftime?
