Hi,
I am moving and gave 30 days notice in writting, signature return receipt. My complex wants 60 days notice and insists my lease automatically renewed. I never signed the new lease and called to say I would be sending them my notice soon. The original lease stated 60 days or 30 if month to month. I told them I am month to month but they said I would have had to pay a large fee each month to be month to month. They said they considered the lease to continue even though I did not sign. When I argued this they said then you are a holdover. They cashed my chescks and even put in a dishwasher and I paid a small increase per month. It does say the amount in the lease if going month to month but I continued paying the same rent because I didn't know nor did they say anything. With this new lease that I didn't sign a new utility bill is required for the water. I never agreed to pay for the water. I had complained about lysol, (all my neighbors are from India and they use it to cover the curry smell) in the hallway several times; nothing was done. I called them and left several messages that I could not breath from it and it is on my telephone bill that I called. I have a doctors note stating I am greatly affected and I had sent them a letter that I cannot be around pesticides and I needed to know if they were spraying the hallways. I was told they would not. My neighbor just informed me they are spraying and this would explain my problem with not being able to breath and I had to get an inhaler. I want to get it in writting from my neighbor and ask the office if they are spraying because I have the letter I gave them and they signed that they received it.
My question is can I get away with just giving them 30 day? since I never signed the lease. They want me to pay for the following month and told me they will be sending this to collections. Can they be responsible if they did spray. I think they have to tell me and I saw the co name for the Exterminators. I have had all kinds of symptoms and visits to my doctor for rash, breathing etc. Thank you. Lynn

No one on here can really answer your questions because it depends on what your lease says, not your interpretation of what you want your lease to be. I suggest that you take the lease to an attorney that offers free consultations or to a legal aid free help night to get some assistance in understanding your lease provisions. If none of that, someone who can read the lease more clearly and objectively.
