I am the mother of a two year old, his father and I have never been married. Father did sign birth certificate, no support although he did live with us off and on. My question.. What are the legal implications if I move out of state with my child.

Are there any court orders for CS, custody, visitation?

If there is check the order, there may be a clause about notifications of moving out of jurisdiction.

If there isn't any court orders, you can legally move, however, the father has the legal right to file papers and force you to bring his child back.

If you and the father agree on the move and have visitation planned , there wouldn't be any problems unless one of you disagrees later.

probably none though I suggest that you get a court order that you have sole custody either before you leave or after you establish residency when you move, though better is recommended so he cant call up and say you kidnapped the child if he gets angry

Kidnapping cannot be charged if there is no custody orders. If you move out of NC to another state, he can file to force you to bring the child back, but having done this (from NC to TX) I came back for court, but was not ordered to bring the child. It was "strongly suggested", but not ordered. So, decide what you are willing to risk. My suggestion is to file for cutody after establishing residency, if possible.
