I am a non-exempt, salaried employee. However, I was told that I will not be eligible for overtime until I have worked 45 hours a week. The way the HR department explained it, I will be paid a set amount each week and then if I accrue more than 45 hours in a week my overtime rate will be figured at a pro-rated amount. (Base salary / 52 weeks / 45 hours a week * 1.5) Is this legal under Kansas law? Please refer me to the statute that will explain this policy.

Also, my offer letter states I am at an annualized rate of $xx,xxx.xx. It makes no mention of how many or what hours I am expected to work... So what happens if work less than 45 hours? - Can I be docked pay?
How 'bout if I work less than 40 hours? :confused:
