Hello,

I'm currently planning on leasing a fairly expensive (for me anyway) apartment in southern NH. I have to make this move fairly quickly due to my fiances failing health. At some point, five or six months for now, we may be able to live together at different location so I'm trying to gather info concerning subleting and assignment because this place requires a 12 month lease. If someone could enlighten me on these matters I would greatly appreciate it (or point me to somewhere to look).

to sublet or assignment a lease clause has to be written in the lease do not do it verbally or sign a lease that doesnt have one. if you plan on moving in 6 months ask if you can have a 6 month lease or month to month lease

This is as i expected however I thought I heard somewhere that state laws could over-ride any lease agreement.

thats true, i dont know of any law to allow a lessee to sublet reguardless what the lessor says
Agreement between a Landlord (Lessor) and Tenant (Lessee) that grants the Tenant (Lessee) the right or permission to assign the lease or sublet the premises. In the case of a residential lease, this permission is usually necessary before the Tenant can assign or sublease to another person or company in a binding agreement. In the event that the lease permits assignment or subletting without written permission from the Landlord (Lessee), Tenant can assign the Lease with an Assignment Of Lease Agreement without need of a Permission To Sublet or Assign from the Landlord

Get a month to month lease since your situation is uncertain. If you cannot, try to find a longterm stay place like a hotel or corporate place that specializes in month to month stays or thigns like that. And even a hotel with a monthly rate may be better.
