View Full Version : divorce leaves me with name on note but not title

I live in Georgia, and was divorced about 2 1/2 years ago. In the divorce settlement, it states that i have no financial responsibilities as far as any property my x and i had. However, my name is still being associated with our mortgage. I asked her about a year and a half ago to refi, but she was afraid she couldn't afford. Now I am ready to buy again, and am being held hostage by this debt to which I am attached. Any advice would be GREATLY appreciated. :confused:

The mortgage company is not bound by your divorce agreement. If your ex is not complying with the requirement to re-finance the mortgage into her name, your recourse is to take her back to court to enforce the divorce decree because, at this point, she's in contempt.

First, talk to your divorce attorney and see if this is covered in your property agreement because if it is, then that should be enough for you to get free. Mortgage companies should honor court decrees. Now getting or forcing the decree is another story, if your ex is not refinancable.
