i work in north carolina as a waitress and i make 2.15 and hour. my bosses put a new system in place that dictates how much we claim in tips. if we make 30.00 in credit card tips then it mandates that we claim 30.00 in cash tips. not all customers tip the customary 14 percent. because of this new system and my boss refusing to override the system i got a check that said void on it. he stated that i made too many tips and my pay was taken to cover taxes. after questioning this practice.....i was fired for allegedly stealing a piece of pie........nothing i can prove!! is this legal.

You can be fired if they think you stole a piece of pie (sheesh), even if they were mistaken.

Now, relative to tips. You must claim credit card tips and cash tips. The employer, however, cannot record more tips on your paycheck than you actually received. If they are padding the paycheck, you can file a claim with the state Dept. of Labor. If the tips recorded were correct (which must include credit card tips), then it is perfectly legal to have your cash wage "eaten up" by taxes.
