can our ex-landlord charge us for new carpet if she did not replace it? we recently got a bill stating we owed her over $850 for new carpet, but when a friend saw the apartment today (which is currently for rent) the landlord stated that she had not and did not plan on replacing the carpet. can she charge us for this?
also, she charged us for re-painting the entire apartment but told my friend she only painted one wall and did touch up work other places. total, she charged us over $250 for paint, a total of 5 gallons and 8 hours of labor.
also, can we be charged for snaking of the drains? we used drain-o a few times and everything cleared right up for us. we just figured this was normal. it was over $150 for this service.
our ex-landlord seems to have a warped sense of things, and we were just wondering if this is acceptable behavior. thanks.

did you pay a security deposit? she would have to send you an itemized list of damages and costs and the balance of security returned or owed.
write a letter requesting to see the receipts for what shes charging, if she doesnt respond take her to small claims court to get your deposit back, she will then have to show proof of the charges
Landlords must provide receipts documenting the costs of claimed repairs or estimates, unless the landlord does the work themselves (in which case they must describe the work done. In either case, if materials are purchased, copies of the purchase receipts must be provided (or estimates).

yes we paid a security deposit of $450. she did send us an itemized bill with a total amount we owed. the security deposit was not taken from that amount. she refuses to provide receipts until we pay her the remaining balance.
what i don't understand is how she can charge us for things that she did not replace or plan to replace. she is re-renting the apartment as it. no new carpet and hardly any paint. yet we are being charged for her replacing both in the entire apartment. how is this legal?

take her to small claims court for return of your security. see if you can get pictures to show proof she didnt do any of the work claiming. she also has to show receipts to the courts for her proof. bring your letter showing she did not deduct the 450 from the amount charging.

Sue for your deposit and take the friend with you to court to testify-- should see the landlord do a big 180 there. You can ask the landlord also, but it may have greater effect in court. Consutl an attorney locally also.
