My tennant is going to vacate my rental property on the last day of the month. Can I tell him he needs to be out at a certain time or do they have the entire day to vacate?

if there is no time frame in the lease, in some states it has to be reasonable time to vacate or not after 11:59pm.

The tennant and I do not have a lease. He would not sign one. He verbally told mehe will be moving out on March 31st. I told him I needed a letter. I never received one. I sent a registered letter telling him I needed a letter from him with a forwarding address to send deposit and what I would expect when he vacates. He has not responded with a letter nor does he take my phone messages. My question here is a two part one.. First, since he did not give me 30 days written notice do I have to give back the deposit? Two, since he has not sent the letter I was wondering if I can ask him to leave by 5PM March 31st so I can clean the rental house.

My fear here is that I have someone that wants it April 1st and I am thinking he will not be gone on April 1st. He has caused me many problems in the past few months and I was in the process of eviction until I received the verbal request.I guess in hindsight I should have proceeded with the eviction because he was late in payment for March and $215 short. The $215 I am going to deduct from deposit.

Any help would be greatly appreciated.

it would be hard to prove since everything is done verbally therefore he could fight you for the deposit
not clarifying a time to leave is another problem
Don't rent your residential property without a detailed written agreement. Though most states allow verbal rental agreements, they can easily lead to disputes later.
deduct the 215 and if he is still there, dont accept rent if you dont want him there and start eviction procedures

You should read your lease to see if ther is a time included. If not, then you should suggest one that is realistic for the lease and make this known in writing. If you need lease interpretation help, consult a local attorney.

This is a month to month lease. Can I still ask them to leave at 6PM the last day of the month?
