I have been an employee for a very big pharmacy chain for well over a year. The pharmacy manager is a very rude, condescending, and smug woman who visibly treats everyone badly, however, treats minorities even worst. Off the bat I established that I am not to be treated that way. Still she continues to berate us. There are only 4 fulltime workers, 3 white women, me the only minority. When any of the other three women refuse anyone service or asks the customer to leave she either does not get involved or backs up the other full-time women. This is not the case with me being that she has let customers repeatedly insult me and does not ask them to leave when I refuse service. Recently a customer cursed at me and when I asked him to leave she told me to "Shush", provided him service, and allowed him to keep cussing at me for 15 minutes (no lie!). I promptly left the store and called her supervisor and her supervisor's supervisor. The head supervisor told me it was a "tough call" and he will speak to her immediate supervisor. The problem is, this immediate supervisor is a no show. She has never met us, never returned a call or complaint, and I believe the situatiuon is out of hand. How do I deal with this racist pharmacy manager and her allowance to let people insult me? Do I have any recourse against her or her neglectful supervisor?

If she is treating everyone poorly, it isn't legally actionable. It is a tough call when you feel she is treating you worse but doesn't treat anyone well. Are you in the same position as these other employees?

It is also tough to claim harassment or hostile environment based on one example.

Poor management isn't illegal ,but racist behavior is. I would follow up with HR and make clear to them why you feel this manager is treating you poorly and have examples of specific incidents that demonstrate this. It is very hard for HR or anyone else not on the scene to read between the lines or follow up based on vague complaints such as "she backs up other employees but not me", or "she treats everyone bad all the time but treats me worse". If ther are other minorities that she also has treated in a less favorable manner or comments about your race I'd share those as well. Otherwise, to an outside observer, it just looks like you two have a personality conflict that has nothing to do with race. Perhaps because you have openly opposed her behavior. It is still worth reporting and upper management shoud do something about it, but they aren't legally compelled to.
