I live on a shared drive where a right of way easement has been granted. We (4 homes) have each maintained the portion of the drive that is within our property lines. I came home to find that one neighbor has had a truck come and dump crusher run gravel on the drive. She did have it graded and compacted.

My questions;

Was it within her rights to do this? Isn't the driveway that is on my property, my property?

She is now asking for "donations" from the neighbors, I was never consulted and how does she know that I might be having my portion paved? Should I give a donation?

I wouldn't have minded if I was consulted regarding the work or the choice of materials but after the fact? Through my contacts I could've had it done nicer and for a better rate.

Could I ask her to return my portion of the drive to it's former state?

She can maintain the easement. she also has to pay unless there is an agreement otherwise. To be fair and keep peace in the neighborhood I would pay my share but notify her in writing that this is the only time.

It is a donation- so don't contribute. In the meantime, I suggest that you maybe post a sign telling others to KEEP OUT or KEEP OFF your property.

How does a property owner maintain only that portion of drive that is on their particular property, if the particular owner actually drives part-way onto his/her property?

What are your rights and responsibilities, if you're the last owner and have your idea of "what" maintenance means in direct contradiction to the other 3-owners(who own monster 4-wheel drive trucks), or have a vehicle, like a Ford Focus, that cannot traverse the first three parst of the drive.

just wondering out loud about the problems with "shared maintenance" drives, when the "sharing" part is not specified.

Did this person have the material delivered out of frustration of the other parties allowing the drive to fall into disrepair?

. . . again, just wondering
