Members of my department recently had our titles changed and were moved to exempt positions from non-exempt. Our work has not changed and we are still expected to work the same amount of overtime that we did while at an hourly pay rate. The rate chage was also retroactive one week. We are technicians, but do not fall under the computer technician exemption, altho our new title would make it appear so. Is this legal? The corporate headquarters are in another state. Thank you for any information you can provide.

Without knowing exactly what your job duties are, we would have no way of forming an opinion as to whether you can be classified as exempt or not. What exactly do you do?

We are PBX technicians. We install hardware, program, work with communication lines, run cabling etc.

Well, that's not a lot of information, but I'm guessing you would not qualify. You can contact the federal Dept. of Labor and speak with an investigator about your specific situation and they can give you an opinion.
