I am cutting my hours from 40 to 35. I was under the impression that California clarifies 32 hours or more as full time. My employer is saying since I will be working less than 40 hours they can no longer provide me benefits (health, 401k, vacation time etc...) is this legal?

In California my wife cut her hours down from 40 to 24. At her job they only need 20 hrs. to qualify for full bennies. I was under the impression that most employers require 24 hours to qualify, Hope that helps. Good Luck!
According to a colleague of mine who has studied the issue, there are only two states in which the law EVER sets the limit on when an employee is full time for benefits purposes. California is one of those states. However, it is not, according to my friend, an across-the-board regulation but applies only in certain circumstances. I have not been able to open the link he sent me. Hopefully one of our California experts will be able to clarify the issue.
