View Full Version : Eviction notice in Denton, tx - noise complaints

In the last 2 weeks, the downstairs neighbor has filed a noise complaint any time my 2 year old nephew has stayed the night, 4 nights, 4 complaints. Even called the police, who came by and said 'try to keep it down'. The noise is caused by the child walking around the appartment, I guess you could confuse it with banging on the floor. We've explained it to the neighbor, the police officer who came by, and the appartment management.

Yesterday, We received an eviction notice due to excessive noise. Which also said I'm not alound to have visiters over anymore. I'm wondering what my current options are. Especially wondering if the nigherbor is just being to sensitive. Any suggestions would be great, particularly if you think, I should just not bother fighting it at all, and move on.

it probably would be better to move seems like your neighbor will always have complaints.

Well..are all the complaint's made when only your nephew comes to visit or is the neighbor complaining all other times as well?
I do know that in some apts the walls and floors are thin, so if you don't live under someone then it is hard for you to notice the amount of noise you could be possibly making unintentionally.
My neighbors underneath me are horrible noise makers and play music all during the night and sometimes 4 and 5am, and they play it so loud it shakes my furniture and cabinets, and we have informed them on numerous times and they will turn down music only to turn it back up trying to be funny.
My upstairs neighbors walk heavy across the floors and they just got a rottweiler dog as a pet (which is not allowed..per lease agreement) and the dog just runs across the floor all day throughout the day and is huge and sounds like a 400lb animal. It is very nerve racking. I get woke up while sleeping all the time because of this inconvience. Because it sounds like both my neighbors are having WWF(smackdown) matches.
My advice to you would be...if you can't find a way to remedy the complaint..then maybe request to your landlord that you move to a downstairs or bottom unit. Or find somewhere else to live..because everyone deserves to come home and enjoy the comfort of their home, in peace. But i always take it as a learning lesson...everytime i move and i request end units and now i can't use a treadmill to run on because i don't want to inconvenience my neighbors below me with the noise of me running or jumping around. Out of respect to neighbors although they do not show respect for me and other neighbors. So if you feel threatened by neighbors and feel you can't move around in your own home without feeling fearful of if the neighbors may hear you, or complain about noises...then move...also next time you move do research on the place especially if it's a apartment complex/community.
Go to... aptratings.com and do a search, because most of the comments made there are from actual residents who can give you insight on whether or not you want to live there as well as any problems with office staff/management.....best of wishes and good luck

If you can do a mutual release and get your deposit back, leave. I think it was the police that did it for the landlords and maybe they value the other tenant over you. Try to move to a place that is more child-friendly. Consult a local attorney also to get their perspective also.
