i work in public saftey (911 dispatcher). We are discussing the possiblity of moving to 12hour shifts. Our Deputy Mayor has come up with a plan to cut our salary by approx 3,000/year and make up for it in the overtime that would compile each week from the 12 hour shifts. So my question is....If an employer mandates overtime, can he/she dictate how you are to be paid? It has always been my understanding that if the overtime is mandatory, the employee chose whether or not he/she could take the overtime in pay or compensatory hours. thanks

That is correct in governmental entities/agencies. Comp time cannot be forced if the employee prefers the overtime.

I have a question about overtime. I worked for a sheriff's department in
Indiana for almost 2 years. We were never given the option to be paid for
the overtime worked. Every single hour over 40 we worked was comped no
questions asked. We were never given the option to be paid for it or to
comp it they never even let us know they had to pay us if we
requested to paid. Is this legal?
