State: CO
Issue: in a restuarant during a non-business hours varying 5-6 hours shift, what are the laws for breaks, if any. Should there be a paid 10 or 15 minute break or should it be off of the clock.

Colorado requires a paid 10-minute break "in the middle of" each four hour period worked. Colorado also requires a duty-free 30-minute unpaid meal break be provided when the work schedule exceeds 5 hours of work. If a duty-free meal break is impractical, the employee can be permitted to consume a meal on-duty provided the employee is fully compensated for the time.
