Hi,
my name is Mike and I live in SC. Recently I had to renew my lease but before doing so told my Apt Mgt that I would be out of town when Feb rent was due. I would be paying it late because I would be out of town, and would need to get back and depsit a paycheck that I would receive while I was out of town. Since I was renewing my lease they of course had no problem with this and told me to post date a check and give it to them prior to going out of town. When I went to the office with my check on 1/27 (dated 2/10) they told me that they could not accept it. They had just gotten 'yelled' at for accepting a postdated check from another tenant that moved out prior to the date on the check. I was very frusgtrated since we had a 'verbal agreement' on their accepting my postdated check. Upon rerturning to town, I paid rent along with a 10% late fee (this was paid on 2/10, same date i was postdating my check for). During the time of my absence the apt complex filed for my eviction (this was done on 2/8). The complex now says that I owe them $100 eviction fee. I really do not feel that I owe this, nor do I feel that I owed the 10% late fee since we did have an agreement. I do not mind the 10% but the $100 is over and above the top. I just renewed my lease, and I told them that I was going to be out of town. They could have looked in my apt and seen that nothing was packed. Any help??? Thanks all.
