What do we do? Our tenants said they were gioing to buy the townhouse they've been renting for the last 2 and a half years in Olathe, KS. We helped them get approved by telling the lender what good tenants they had been. Then at the beginning of Feb., they asked if they could use the security deposit as rent for that month since they would be buying the apartment really soon. We said sure, why not. It seemed fair. Then time passed and time opassed. They became harder and harder to contact, but kept saying that any day now they would have the loan. Finally last week I went to the place where the guy works in Kansas City , MO and asked. He said they had finally gotten the loan and we would soon have the papers. Nothing. I went back and he said they were in the mail. I returned on last Thursday and he said they had accidently sent the papers to the apartment instead of to us and could I pick them up on Friday or Saturday. I said sure. I went out and waited for ages and no one came. I tried calling and calling and no one answered. So today, Monday, 3/6, I took our set of keys and went back to the apartrment. Surprise. They moved out a month ago and left us a note saying that we wanted too much money for the place and that they had tried to mail us the keys, but that they were returned. So we have no tenants,and no rent money and they have broken their rental lease, which says that they should pay us until the end of June and that they must give us a 30 day notification before leaving. I think they should owe us for 5 months rent plus the deposit.
How should we proceed???

you have to go to landlord tenant court and file a suit

I hope so, even if it's somewhat less than what they probably should pay, it's still more than we have now and not so expensive to go after. Any other ideqas out there?

Sue them. You know where he works, so that is good as he will probably have to get served there and if you win, go for garnishment. I think what they did was really dirty, especially the way they used up the deposit as last month's rent. It almost makes me think they were never going to buy and it was a ploy to use the deposit as last month's rent. Consult a local attorney.
