I was worked in a large company in Kentucky. In February I was terminated because my job was being outsourced. I was signed a seperation agreement in February. In the agreement I will receive 16 weeks of severance pay starting after my last day of work on Feb 3 and stated that the agreement must be executed no later than 21 days after my last day of employment. As I still not receive my 1st serverance pay check until last Friday on March 3, I called HR to found out the status. A HR lady told me that they did not have my signed agreement and told me to fax it to them so the agreement can be released. I asked her whether or not my severance is processing. She told me no one else has a copy of this contract so she cannot follow up until I send to them! I told them I do not have fax machine at home and they told me I can go to Kinko's or give it by hand. I felt I am being very neglect and they are in purpose to delay my pay. I am wondering whether this contract is still valid. If I sue the company, what is the chance to win the case.

Your any advises would be very appreciated.

The company seems to be working with you to get the signed copy. You're jumping way ahead here. Get them the signed copy first and then find out when you will receive your first payment.
