View Full Version : Los Angeles city: 3 rent increases within 12 months

Hi,

In August 2005 my rent increased by three percent. This was okay and normal.

Then in January 2006 my landlord increased my rent again pursuant to the Passthrough of Surcharge for the Systematic Code Enforcement Fee described in section 151.05.1.D of the LA Municipal Code (www.amlegal.com/nxt/gateway.dll/California/lamc/municipalcode/chapterxvrentstabilizationordinance).

Again, this looks legal too.

But now, beginning in April 2006, my landlord is demanding another four percent increase. Is this increase legal?

I am almost certain the answer is “no.” It looks to me like I am protected by LAMC 151.06.D (www.amlegal.com/nxt/gateway.dll/California/lamc/municipalcode/chapterxvrentstabilizationordinance). Afaik, this law imposes a lock-down of 12 months between rent increases.

Is my understanding correct? :confused:

I think so.

In my mind the big question is this:

Which rent increase reset the 12-month clock?

A) My rent increase of August 2005?

Or,

B) My rent increase of January 2006?

Sometimes I can be really dumb. Maybe I am overlooking something. Any questions or comments?

Consult a housing specialist attornet in LA. I think you forget this site does not render legal advice and that is what you want. I also suggest that you read your lease to see how it reads in relation to the local ordinance.
