I was recently terminated from my job of 5 1/2 years. My employer's policy is to pay unused vacation at termination but he is refusing to do so. I sent him a letter stating that according to his employee manual I am owed for 3 weeks which comes out to a little over $2700 and am waiting for a reply. I read that the IN dept of labor does not handle this. Is small claims court my only option?

I've been on line all day and also spoke with someone at the Indiana department of labor today. According to the representative, I AM eligible to receive my vacation pay (one week's worth).

The company says otherwise...citing I was terminated for fraternization...and because of that, Indiana will not pay it. I told the girl at the labor office that and she laughed. She says I AM entitled.

I'm not laughing yet...what is the correct answer to this???
