I have a problem. I worked at a nightclub as a waitress for nearly a year, when I was moved to the door girl position. I have been there for nearly 6 months. I was 2 months pregnant when I moved to the door girl position. I am now 8 months pregnant and have been dismissed from my position. A new girl who is very thin and not pregnant now has my job, and I was told that I can call back to try to get my job after I have the baby. No other reason was given for my dismissal, other than the owner liked her better. I was wondering if this is legal and what my options are.

If you were fired because you are pregnant, that is illegal.

If you were fired because the manager likes the other girl better, that is legal.

However, the fact that they told you to reapply after the baby is born makes this scenario lean heavily in the direction of pregnancy discrimination. I think you have valid reason to discuss the issue with an employment attorney and/or the EEOC.
