Hi Guyz,

I am relocating to another state and have to stop my lease 4 months before the lease period. when I signed the lease i discussed with my landlord that I will give one month notice if I have to break my lease in between. He agreed to it then but it was all word of mouth. Now I am leaving for another state due to my job change and was wondering if my landlord will impose a penalty to pay for the remainder of the lease. what should I do if he asks me to pay the remaining rent that amounts to around 5K and I cant afford that. Any advice on this would be greatly appreciated as I am having sleepless nights due to this. One thing I was thinking is that I may ask my landlord to help him find a suitable replacement before I vacate because all he is interested in is getting money from the Apt as he has to pay the mortgage on it. Please help.

How did you make out? As with everything in life.............if you want to prove your position, document it. Did you get paperwork that reflects your conversation? Probably not. Lesson learned........suck it up, pay the man and move on - a bit wiser

first read your lease and see if there is any mention of early termination. you do have to give 30 days notice, did he state that you wouldnt be responsible, that he would just let you out the lease free and clear. a suitible replacement is your best bet because you are responsible until the landlord rents the place, you may also be responsible for ad costs. good luck

I suggest asking for a mutual release to be signed and letting the landlord keep the security deposit and moving on. You should consult your lease terms and get any agreement to terminate in writing so it is also legally enforceable should you have to go to court.
