:confused: I have been working for GM customer assistance for a year and prior to this job I worked customer service for 5 years and now I'm being laid off with GM because is moving overseas. I will be starting my new Job with Humana Health Care 3/13/2006 and I'm eligible for health, dental, vision, short term and long term disability starting on day one. However, the company wants all new employees to work 120 days (4 months) before taking any days off. Well I'll be working 2nd shift so doctors appointments want be a problem. The problem is that I'm due 7/14/2006 and I will have to have a C-Section because I had one 2 years ago (which is fine). 7/11/2006 will be 120 days. What can happen to me? Can they fire me if I don't make it through the 120 days. What are my rights? Please Help..........

You are going to have to ask them what your options are. As you will have only been there a few short months there aren't any laws that grant you leave. However, you can not be treated differently because you are pregnant and must be treated just as any other employee of a similar tenure who needs the same amount of time off for a medical reason.

Say that I work the 120 days then What can happen. Can I still take Short term disability?

That depends on the terms of the STD plan.

WE DON"T KNOW. It depends on the terms of the disability plan. The law does not dictate this.

All plans specifiy a certain amount of time that an employee must be employed or a certain number of hours that must be worked before being eligible for STD benefits. Being enrolled immediately does not mean you are eligible for benefits immediately. Without reading your plan documents there is no way anyone here can tell you if 120 days is enough to qualify. I've seen plans that require as few as 30 days (very rare) and others that require a year of service. It really does vary.

You will have to ask your new employer for details.
