I live in Baltimore City, Maryland and the roof in my apartment leaked back in September '05. This created mold on my wall and ceiling. I immediately called the management company to complain. But they said they couldn't do anything until the rain stopped. They didn't do anything then either. In December, I sent a certified letter complaining about this and other issues in the apartment. Maintenance came out and simply sanded down the mold and painted over it. Clearly, the mold is still there. I want out of my lease (which ends June 30th), so I am thinking about sending another certified letter threatening legal action. Do you think I will be able to get out of my lease, and should I assume the management company will want to avoid any legal action from my end? What are my rights concerning this?

First, you need to go consult an attorney in MD to get your rights so to speak. This is not a site to render legal advice. That being said, depending on the type of mold, it could be that if they used a certain type of paint that seals the mold that you are safe. But I am not moldexpert, nor are you and this is complex because it depends on the type of mold and then it could be they cut out the mold, replaced it with new drywall patch and painted over that. So not sure you rreally have a case unless you really know what was done and if it was the safe way to address the problem. If you do not know this, then it is up to you to breach your lease if you choose to but be prepared to be sued or have legal action taken against you unless you can get the landlords to execute a mutual release.
