I have no issues with paying support for my daughter....but the courts are trying to rape me...let me explain a little.

My daughter lived with me here in NY until 7/1/04. At that time she was 15 turning 16 and of course the grass is greener on the other side. LOL!
The whole time she was growing up, her dad only had to pay $50.00/mo. When I met my second husband I went back to court and they ordered him to pay more support and because he got smart w/ the judge was ordered 10 years arears as well. He still owes me more than $3500.00 but works for himself so he can hide his money...of course they have tried to garnish his wages but to no avail.

When I went to court for the first time in January of this year (now he is taking me) the same judge ordered for me to pay him $50.00/week. I only make $8.00/hr. I have no health insurance and have 4 other kids to care for on my own...(divorced again). After my rent, which is $585.00/mo and the support of now $46.00/wk plus the arrears of another $50.00/week added to that....leaves me with only $20.00/wk for utilities, food, health insurance, ect.

The court did not seem to care that it put me in this situation....any advice?

I hope someone can help....

As far I know there is no help, I am in the same boat tho my story is different money wise it is the same story. There is all these guidelines and statues, and everyone gets rubber stamped thru them.

I take it since you pay the same amount of CS as your x that you both make the same amount of money? They have guide lines that is based on your income. What I dont understand is if your H owes for back support and has not paid it, why has he not be charged with contempt, and to me the best way for him to work out the amount he owes is that they figure what you pay and instead of sending it to him they take it out of the amount that he owes, once the balance is 0 then you start paying CS to him. To me that sounds fair and the right way to do it.

I am on a mission to try and change CS guidelines and laws, for them to look at them from case to case instead of just rubber stamping everything. I have been writing letters about my case and I actually got a call from one of my state legislature and he wants to meet with me. So hopefully ......
