Question: An hourly employee is required to perform annual requalification. During this training cycle the company pays the hourly rate. If the employee was to fail a training course the company is requiring the employee to come back at a later date to requalify. The problem is that they are saying that they do not have to pay this employee while they are at work requalifying on the second attempt.
How can they schedule you to attend training but not pay you? What if you got hurt during this training cycle and your not being paid. Are you still eligible for worker compensation?

If this is mandatory training during regularly working hours, my opinion would be yes. However, if the certification is required to do your job, the employer could very well suspend you without pay until you pass it.
