View Full Version : Colorado - OT or comp time for computer professional ?

Hi - I'm trying to find information on OT vs. Comp Time for exempt computer professionals in Colorado.

I currently am a Network Engineer, and I regularly am asked to "spin up more hours" or work OT. I want to know what the criteria are for determining if I should be getting paid OT or not. Or if comp time is even legal in Colorado ? My company refuses to let us track our comp time or put this as policy in writing, yet continually says "we'll take care of ya"... yet when we want time off, they say "you have to put in for vacation"... frankly I'm tired of it...and their refusal to document things makes me wonder...

If you really are an exempt computer professional, then you are not legally entitled to overtime, comp time, or anything else over and above your regular salary.

so what conditions or criteria would allow an exempt employee to get OT ?

is comp time illegal in Colorado ?

Whatever the company chooses to provide. What I'm saying is that there is no law saying that exempt employees must be paid any extra pay, ever. That's what exempt means; exempt from overtime.

If the employer decides they want to provide comp time to exempt employees, they may. They don't have to. If the employer decides they want to pay additional pay for working extra, they may. They don't have to.

The only criteria in which an exempt employee can receive OT, in any state, is if they have a contract that says so or the employer chooses to offer it. There are no circumstances whatsoever in which the law grants an exempt employee the right to OT.

Comp time is not illegal for exempt employees in any state. But it is not required by law in any states, either. In all 50 states, it is up to the employer whether to grant comp time or not. It is completely voluntary.
