good morning to all, and to all good moring. please can someone help me or direct me in the right direction on getting my wages garnished twice by the same state. I'm retired military and I have been paying child support for my son through military allotments ever since he was 6 months old. several years ago the state of florida garnish my wages for 2 months for the same amount that I was order to pay by the court. I live in the state of south carolina, this action had put a strained on my imediate family let alone my finances I had to let one vehical go in order to survive. Now the stae of florida is at it again, I'm employed at another job and the same thing is happening all over again (still paying thru military allotments) this time the tell me it's because they a new system which automaticly search the system by social # and bam!!! gotcha again. I'am slighty behind on my payments and this is due to other garnishment, but keep in mind I never stop this alloment . can anyone tell me what i can do to get some relief with this state :mad:

I have on more than one occation tru=ied to figure some of that stuff out myself. My husband has been having all of his federal and st taxed offsetted for the past 4 years. He owes back support and the letters we recieve all say they are going towards back support. He got his yearly statement form Social Services and they are telling him that in 4 years his back support has not decreased by the amount from the offsets. He had to go to court yesterday for modification and Social Services is telling him that the Mother of his kids must have been on some sort of state assitence and he owes the state back all thier $$ then he has to start paying her back. Maybe I'm understanding this wrong but doesn't that mean that she is getting paid 2x's? The last tome he went to court about 3 yrs ago averybody agreed to the back suppor amount and NO ONE metioned anything about state assitence being recived on her part? I can certainly feel your pain jaylee61.

i dont understand military allotments, does the military enforce that due to your child support order or is it their own policy for you to pay by their guidelines. you say your behind but the allotment never stop, thats why i ask

Is the court order in one state and another state is doing the refund intercepts? For instance, my husband's order is, and always has been in Fl. his ex lives in Ga. Legally, Ga. child support enforcement was able to intercept tax refunds, they are, SUPPOSED TO report the collection to Fl. however, they refused to, so my husband did not get any credit towards the arrears for those amounts. (He even had it put into a modification that Ga. HAD TO report to Fl, but they still didn't. It took 3 yrs for him to get part of it credited. That may be part of why the balance hasn't gone down.
Interest could be another reason, if interest is being added it may be yrs and yrs before he sees the balance go down.
Another possibility is this: in some states when a CS arrearage is "established" by some kind of court order (ie; contempt, certificate of delinquency signed by a Judge, etc) NOTHING is credited to that established amount until a court actually orders it to be. There have been cases where the NCP has paid extra above the normal amount and thought they paid all arrears, just to discover later that none of the extra was ever credited and NCP stilled owed original amount.
Check into all those possibilties.

Florida's new system is really screwed up. You can try getting a copy of the paper showing that the CS is garnished from your retirement and send it to DOR CSE with a letter stating that the garnishment from other income must stop, as it is illegal. You might have to be very firm with them about it because they are dealing with so many screws up right now.
Do you know the address of the CSE? If not, you can call the toll free number to find out which office to send it to 1-800-622-5437
Also, make sure to mail it by certified return reciept so that you can prove when it was mailed. Good luck.

Yes it is in 2 different states. We are in CT, and she originally was in FL. 2 yrs ago she moved to GA and hasn't even told anybody she moved. The state and his employer is still paing the state of FL. His employer will not change where they send it because there is no court order. She had at first claimed that she had NEVER recieved any support at all wich came out to be 26k. We after much research came up with proof of all but 10k. This was 3 yrs ago. After everyone went through all the proof ( CT child support, FL child support, and ourselves ) Reluctently he owed 10k (cash doesn't count w/out proof or reciept. They even included one of his first offsets in lowering his arrerage. How does most of this interstate stuff work? Am I understanding correctly that she is ultimily getting paid 2x's? You can never get a straight answer from anyone. You are always directed to someone else. It is like trying to get in touch w/ the president of US! Just keep questioning Social Services?

Are you calling the state 800 number, or are you calling the specific county that is enforcing the order? You'll get faster results by calling the specific county. Another way to get the county number is to go to http://myfloridacounty.com/ click on payment inquiry and a window will open where you can put in the name of the county and it will give you the number.
Florida does have a law that allows a NCP with a second family to have a second job, and the income from that job cannot be used to calculate CS.

Apparently Florida is collecting the CS then sending it to Ga. for payment to ex. IF the order is in Fl. and Fl. is the state doing the tax intercepts, then he should be getting credit toward the arrears. As I said in my other post, he needs to find out what state the order is in, what state is doing the intercepts and find out if he is recieving credit on the arrears for the intercepts.
