I am Illinois resident. I am with my current employer only 3 months. This is small company (only 8 employees) A week ago I find out that I am pregnant. Do I have any rights? Is this possible that I will loose my job? Can I take maternity leave or not? Everything what I found in the internet looks like I have no rights. Please help me to understand my situation.
You cannot be fired for being pregnant. However, since your employer is too small to qualify for FMLA and since Illinois does not have any state-mandated protected maternity leave, you are only going to be entitled to take as much leave as another employee who has been with the employer for just under a year and who has a non-maternity medical condition. How much time that will be is up to the employer.
You cannot be discriminated against for being pregnant but you get no special privileges either. Your employer is required to treat you exactly the same as if you were not pregnant. That means you get exactly the same amount of time off for doctor's appointments and exactly the same amount of medical leave as any other similarly situated employee. You are held to exactly the same standard of performing your duties as any other employee. And so on.
