My wife works for a doctor in Texas, cancer clinic. My wife informed the doctor that she was pregnant. The doctor gave my wife two weeks notice, also told my wife that she could not work around the medication for cancer patients and she had no place else for my wife to work. What rights does my wife have?

Couple of things first. How large is this employer and how long has your wife been there?

Is there truly a danger in her working around the medications while pregnant? If so, then her employer does not have to allow her to do so in spite of the risk.

Have they allowed other employees with medical conditions of a similar duration to work in a modified capacity? Modified Duty isn't a legal requirement but if others are allowed to, she can not be denied this just because she is pregnant.

Is there any other reason you have not shared that the doctor might terminate your wife?

It is dangerous for her to work directly with the patients using the cancer treatments. She has been there for 6 months, a total of 5 other employes work there. As far as I know no other employee has been pregnant. But not all work in the lab, most work out front. Answering phone, setting appointments, billing and such

Given her short tenure, the small number of employees and the fact that she is not safely able to do her job, I'm sorry but it appears legal. Her employer does not have to allow her to assume risk to herself or the baby.
