My wife is 7 months pregnant and recently advised by upper management that her position after two years of employment is going to be eliminated. She has two choices: 1.) to look at other opportunities within company doing something different or 2.) look for something else outside the company. We all know if CA that at 7 months pregnant nobody will hire a pregnant women regardless of her extensive background. Do we have recourse if she is terminated or if she goes thru her pregnancy and doesn't have a position to come back to? Thank you.

What reason was she given for the position elimination? Is this part of a downsizing or RIF?

Being pregnant does not protect her from any actions that would have been taken whether she was pregnant or not.

My wife is being told that they don't want to support the position that they originally hired her for. Since her employment with the company she has brought into the company a ver, VERY large contract that the company would be benefiting from. Does she have recourse if she decides to not pursue another position within the company or is just terminated? She would like to see this though and stay within the company.

For this to be illegal she is going to have to provide valid evidence that she is being terminated BECAUSE OF her pregnancy. Can she do that? The fact that they are suggesting that she look at other opportunities within the company strongly suggests that her pregnancy is not a factor, in which case what her employer is doing is legal.

She does not have a guaranteed legal right to stay in a job that the company has a business reason for eliminating.
