I am an assistant manager at a service station in CA on salary, I have worked well over 8 hours on some days. Is it right that I dont get OT pay because I am on salary?

However, many "assistant managers" have won overtime pay. You might be exempt under the Executive Exemption, however, you must meet ALL of the following: 1. Manage the entire enterprise in which you work or a customarily recognized department or subdivision. 2. Direct the work of at least 2 subordinates in your department. 3. Have authority to hire or fire – directly or indirectly. 4. Exercise independent business judgment. 5. Spend more than 50% of your time doing the above. Many "managers" spend more than 50% of their time doing tasks that have nothing to do with management, such as stocking the store, working cash register, etc. These employees are entitled to overtime. cbg 02-20-2006, 09:59 AM Just as a clarification, while as an assistant manager you might be either exempt or non-exempt as Michael described, IF you are exempt, then there are no circumstances whatsoever in which you are entitled to overtime under the law, no matter how many hours you work. mtracy 02-20-2006, 11:50 AM Thanks, cbg.
