i am from texas and i have a friend who is really worried he will loose his kids. Last year his wife decided she wanted to give temporary parental rights to her parents of their kids. (Educational parental rights or something). In may these parental rights end. He is planning on a divorce and really wants custody. Back in September, him and his wife got into a fight and he pushed her. She fell backwards and hit her head on the shower. SHe charged him with family domestic violence. The children were not at home. THey didn't even live there at the time. He is the one that always has the job, always sends money to the kids, has a car and a place to live. She never sends money to her kids, cant keep a job for more than a month, and lives with her grandpa. Will this domestic violence charge stop him from getting custody of his kids?? He thinks it will.

I don't think that it will keep him from getting his children but they will take that into consideration. Has he filed for custody yet? If he hasn't he might want to get on it ASAP.

It sounds like he made one mistake. Seeing that the incident happened only a few months ago it would be a good idea for him to get into anger management or some kind of councelling and parenting classes. This will show that he is ready and willing to do anything for his kids. Make sure he knows that he needs to admit to the mistake and show that he doesn't want anything like that to happen again. He does need to go file for custody asap. That way he will be in court by may when they lose rights. Good luck to him.

I have a restraining order against my ex and he sees my kids all the time,and they witnessed the event that led to the order. I agree that you should put yourself into anger management classes and parenting classes because the judge will order them. Good Luck and keep us posted
