I have been going through a custody battle since July 2005. As of yet nothing has been decided except that we have to attend co-parenting classes. Part A and Part B..Part A was suppose to have been done by Sept 29 I have finished my part and waiting my ex to finish is so that way we can attended part B together. He is Notorius for missing appointments and not complying with court order or judges rulings. These past few weeks have been hell. On the 5th of Feb he was to come pick up his daughter for his regular visit. He did not show up due to the fact that he had been arrested. Here are the charges. Battery on ex-spouse or person living with. Failure to appear for traffic citation. annoying or pestering a child under the age of 18. I took him back to court on an ex-parte hearing requesting temporary custody/ No visitation. Request denied. He lied to the judge stating that he had no more court dates. I found out otherwise. He has one more court date for annoying and pestering. I fear for my daughter's safety. The only thing that the judge did order is that he present me with a current driver lisense, proof of insurance, and appropriate car seat. Is there anything that I can do to stop this? I can't believe that he is getting away with this again. If there is domestic violence in a house why would a judge allow my daughter back into something like that?
