alright me and my ex had an agreement that was court ordered to pay her directly for support , everything was fine for 5 yrs now , 6 months ago she moved from ny to florida and i havent been able to see my kid since because she thinks of every reason in the world not to let me see him??? so we went from being still kind of friends to not even talking. now i get some papers in the mail saying to agree to her needs or we will be in court? my question is since everything is filed in ny but this new thing she has sent me , will i have to go florida for court or will she have to come here? and also will new support be based on ny or florida laws? thanx for any help in advance

IF there is a CS order in NY, it will stay in NY because you are the NCP and you still live in NY. If she is trying to change the jurisdiction of the CS order, all you have to do is object to jurisdiction change. This applies to only the order for CS, not a visitation order.

Is there a visitation order already? If there is and she wants to change jurisdiction, it will most likely be granted. You will need to either go to Fl for visiation hearings or contact the court clerk to ask to appear telephonically.

Unless it is something that you truly agree to, my suggestion is that you NOT sign any agreements without having an attorney look it over. If you do sign, you need to make sure that she does actually file it with the court and a Judge signs it. An agreement is only good and enforceable if it is filed and signed by a Judge.

thanx , can anyone tell me how child support is based in ny , because mine before was just a joint agreement to pay a certain amount , but now i want to pay what ny says i will have to .

You can go to www.supportguidelines.com to find both the guidelines and a CS calculator.

If you are saying that there isn't any court order for CS now, you need to track down ALL reciepts for what you have paid directly to her, and save all future reciepts.
