When the judge came out he said I had to leave the court room because this didn't involve me but yet the Judge asked the our lawyer to go out and ask me how much I made!!! I said if this has nothing to do with me than he doesn't need to know!!! I refused. If you are not married they will let you be, but be careful if marriage is down the road for you!! I recently inherited a large sum of money from a relative and husband's ex tried to go for an increase in child support. The judge turned her down because she saw right through her, plus the amount based on his income would have been the same anyway. Now, since she moved to another county, she is trying again with a different judge. When calculating on-going CS, no the spouse's income is NEVER used. However, in situations where the NCP is voluntarily unemployed, or underemployed, the spouse's income can be CONSIDERED in imputing income to the NCP. Also, if arrears are owed, the court can CONSIDER the spouse's income. Child support took all out tax return and now they want more money. He called them telling them he has a family to support and they said my daughter and I dont matter.
