FLorida. my husband had a fling with a married women he was not told that the woman was married she got divorce a month before having a child . She told my husband that the kid was his now he is paying child support. can he get a dna test done now that the child is 7 . he asked his lawyer and he said no its was to late. but can he do it on his own and can the result be taken to court.

If the CS is through a court order the lawyer is correct. When the petition was filed for CS it had to also be a petition for establishing paternity and CS. That was the only time that he had the right to deny paternity and ask for a court ordered DNA test. For whatever reason he either didn't ask, or he was found to be the legal father by default. Sorry.
