I live in Michigan , my fiance might be getting this job making 10 an hour 5 days a week and now is only paying 50 a month in child support. How much do you think he will be paying once he starts his new job? Second question mom recieves public assistance in every way plus child support from her other children's father. I was told that she would only recieve the first 50.00 dollars and the rest goes to public assistance is that true? also she only works 27 hours a week will they figure her as a 40 hour working period even though she is working only 27 hours? He is all up to date on everything. Any help would be great. We also have a child together.

It really will depend on the child support guidelines for the state that you live in. Usually, the state can recoup monies for public support rendered to a child. If the states attorney is handling your support case, talk with them.

The FOC handles the child support here in michigan. That was my question is she is on daycare assistance, Food Stamps. So will she only recieve the first 50.00 and rest go to the state?

It doesn't matter what portion goes to the state. What matters is what amount he pays. Using a base income for him of $1,516.00 net per month (new job) and imputed income to her at $650.00 per month (minimum wage 40 hrs a week) I came up with CS of $354.00 per month without insurance or day care. Here is a link to the calculator I used, you can run the numbers because you know the entire situation better than I do: http://www.allaw.com/calculators/ChildSupport/Michigan/

Hello,
what is the deal with taking away the drivers license of the non-payer. I don't understand why the have to pay the child support in full to have them reinstate. I know some people who have worked for a couple of years with and without degrees but can't get to those better paying jobs that are across town or in other cities. People do change for the better. Also why is it ok for the person receiving child support (cs) to work less hours so they can continue collecting welfare, food stamps, medical and everything else. They get free daycare why can they go to school to better themselves. That should be court orderd like the payer is court ordered. My boyfriend is working full-time and school part-time for welding. How do you deal with CS receiver who lies keep the kids away from the CS payer. Has the child thinking the payer wants nothing to do with it. I myself work full-time and and school full-time trying to help my boyfriend. I'm the only licensed driver.

MS, i understand exactly what you are saying. If this person is recieving child support from all these people then she should not be getting assistant because (in VA) that is cinsidered income to Social Services. They need to get tougher with the CP's.

Is your BF paying any CS at all? If he is, he needs to speak to CSE about getting DL back or go into court to get it back.
He can ask the court to impute income to the mother if she is voluntarily underemployed.
Does he have a vistation order? If he does and she's denying visitation he needs to file for contempt. If there isn't any court order for visitation he needs to file for one ASAP.
